Content on the Site, including material referencing ISO 30401, the EU AI Act, the NIST AI Risk Management Framework, SEC and FINRA rules, 21 CFR Part 11, and other laws, regulations, or industry standards, is provided for general information only. It is not legal, compliance, or regulatory advice, and it is not a representation that any Cognatum product or service satisfies any legal or regulatory obligation applicable to you. Responsibility for your organization's compliance rests with your organization; consult your own advisers.

The Site is intended for business and professional audiences evaluating Cognatum. You represent that you are at least 18 years old, that you are using the Site in a business capacity, and that any information you submit through a Site form is accurate.

The Site and its content — including text, graphics, diagrams, product screenshots, and page design — are owned by Cognatum or its licensors and are protected by copyright, trademark, and other intellectual property laws. “Cognatum” and the Cognatum logo are trademarks of Atoka Tech, Inc. You may view, link to, and quote briefly from the Site with attribution. You may not republish substantial portions of the Site, present its content as your own, or use our name, logo, or branding in a way that implies affiliation, sponsorship, or endorsement, without our prior written permission. Third-party names, logos, and marks appearing on the Site belong to their respective owners, and their appearance does not imply affiliation or endorsement by those owners.

You agree not to:

• Interfere with or disrupt the operation, security, or accessibility of the Site
• Attempt to gain unauthorized access to the Site, its systems, or data belonging to Cognatum or other users
• Use automated means to scrape, crawl, or extract content from the Site, other than standard search engine indexing
• Misrepresent your identity or affiliation in any submission to the Site
• Use the Site to transmit malware, unsolicited advertising, or unlawful content
• Use the Site in any way that violates applicable law

Security research conducted in good faith is welcome through the coordinated disclosure process described in our security.txt file, and will not be treated as a violation of these Terms so long as it stays within that process.

Information you submit through Site forms must be accurate. Submitting a form does not create a customer, partner, fiduciary, or confidential relationship between you and Cognatum. Do not send confidential, proprietary, or sensitive personal information through the Site; use it only for the purposes each form describes. Our handling of personal information submitted through forms is described in our Privacy Policy.

We aim for the Site to be usable by people of all abilities and to substantially conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. If you experience difficulty accessing any part of the Site, please contact us at legal@cognatum.ai and describe the issue and the assistive technology you are using; we will work to provide the information or functionality you need and to address the underlying issue.

You represent that you are not named on any U.S. government list of persons or entities prohibited from receiving exports, and you agree not to access or use the Site in violation of any applicable U.S. export control or economic sanctions law, including regulations administered by the U.S. Department of Commerce and the U.S. Department of the Treasury's Office of Foreign Assets Control.

The Site is provided “as is” and “as available.” We work to keep its content accurate and current, but we make no warranty of any kind, express or implied, regarding the Site or its content, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, and including as to accuracy, completeness, availability, or reliability. Content may change or be removed without notice. Nothing on the Site is a guarantee of any particular outcome from using the Service.

To the fullest extent permitted by law, Cognatum and its officers, employees, and agents are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Site, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability arising out of or relating to the Site will not exceed one hundred U.S. dollars ($100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to defend, indemnify, and hold harmless Cognatum and its officers, employees, and agents from and against any claims, damages, liabilities, and reasonable expenses (including attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

The Site links to third-party sources, including standards bodies, regulators, and primary legal texts. Those sites are not ours, we do not control them, and linking to them is not an endorsement of everything they contain. Their own terms and privacy practices govern your use of those sites.

We may suspend or terminate your access to all or part of the Site, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion, including discontinuing the Site itself. Sections of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will survive.

These Terms, and any dispute arising out of or relating to the Site, are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any action or proceeding arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.

If you believe content on the Site infringes your copyright, send a written notice to our designated agent that includes: (a) a description of the copyrighted work you believe is infringed; (b) the location of the allegedly infringing material on the Site; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We may update these Terms from time to time. The current version is always posted here with its effective date. Material changes will be indicated by an updated effective date, and continued use of the Site after a change takes effect constitutes acceptance of the revised Terms.

Entire Agreement.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cognatum regarding the Site and supersede any prior agreements regarding the Site.

Severability.

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

Waiver.

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Assignment.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Force Majeure.

We are not liable for any failure or delay in the operation of the Site caused by events beyond our reasonable control.

Notices.

We may provide notices to you by posting them on the Site or, where we have your email address, by email. You may send notices to us at the address in Section 17.
